Grandparent Eligibility

The law regarding grandparents’ visitation rights is designed to allow those who have been unjustly denied their visitation when it would have beneficial effects on their child to obtain legally-ordered time. However, at the same time it is designed to allow parents to maintain the primary responsibility for decisions regarding their children.

In order to qualify for grandparents’ rights, the grandparents must prove the following to the court:

  • Continued visitation is in the best interests of the grandchild
  • The grandparents are fit to have legally-ordered visitation
  • The petitioning grandparents have attempted to visit repeatedly and have not been allowed to do so
  • The petitioning grandparents cannot visit without court intervention
  • The petitioning grandparents prove that the decision to refuse visitation was unreasonable

Demonstrating these things to the court can be a difficult task to undertake on your own; retaining a qualified Rhode Island family law lawyer who can provide you with reputable legal counsel is strongly advised.
